Appeals court proposal passes Assembly

CARSON CITY – Voters in 1992 and 2010 rejected a proposed constitutional amendment to create an intermediate appeals court in Nevada, but the Legislature is on its way to give it a third try.

By a vote of 38-4, the Assembly on Monday approved Assembly Joint Resolution 7 to establish a three-judge court situated between the district courts and the Nevada Supreme Court.

The judges would be appointed initially and then run for six-year terms.

There was testimony that the judges would be stationed in the Nevada Supreme Court and there would not be a need for a new building.

The Senate has already passed a similar measure and the two houses will have to decide which one will go forward. The amendment would have to be submitted to the 2013 Legislature and then to voters in 2014.

Voting against the measure were Republicans Edwin Goedhart of Amargosa Valley, Ira Hansen of Sparks, Kelly Kite of Minden and Mark Sherwood of Henderson.
