Committee passes bill to curb construction defect lawsuits

CARSON CITY — Republican Assembly members pushed forward a bill today to further protect contractors and subcontractors from construction defect lawsuits by homeowners.

The Assembly Judiciary Committee approved the bill, which will now go to the floor of the Assembly for a vote.

The measure is opposed by trial lawyers, who argue it limits the rights of homeowners.

Assemblyman David Gardner R-Las Vegas, a lawyer who spoke in support of the bill, said, “I have litigated these cases, and I have seen the abuses.”

But Assemblyman Elliott Anderson, D-Las Vegas, complained that the bill “comes at the expense of the homeowner and justice.” He said the committee should have spent more time studying the issue.

The bill is one of the major pieces of legislation pushed by Republicans, who now control both chambers of the Legislature. Supporters cite examples where trial attorneys receive more in legal fees than homeowners.
