An Atlanta law firm says the Cosmopolitan should return $3.35 million an attorney for the firm wired to the casino-hotel without its knowledge.

Real estate law firm Morris Schneider Wittstadt LLC filed a federal lawsuit against the Cosmopolitan, or Nevada Property 1 LLC, June 19 saying the casino-hotel knew or should have known the transfers by one of the firm's attorneys were improper.

The law firm is also suing attorney Nathan E. Hardwick IV in Fulton County Superior Court in Georgia for allegedly embezzling more than $30 million of the firm's funds for his personal use including the casino wire transfers.

The federal suit accuses the Cosmopolitan of soliciting Hardwick to set up a casino account in 2012. The Cosmopolitan could not be immediately reached for comment.
