Complaint: Gentlemen’s club plagued by shootings, gang activity

CARSON CITY — The state Gaming Control Board has filed a new complaint against the Foxy Girls adult entertainment club after one person was shot and police were temporarily blocked from entering the Las Vegas business.

The four count complaint says owners John James Herda and Nicholas Herda ran “an unsuitable method of operation” at the business, which has a restricted license for 15 slot machines or less.

The board filed an initial complaint last year alleging there were violations involving gang members, shootings inside and outside the club and numerous other violations.

The board and the Herdas signed a settlement for the business to pay a $25,000 fine. But the board withdrew that stipulation when this new shooting incident occurred.

The new complaint says Las Vegas Metro Police Officers responded to a complaint there was a shooting Jan. 1.

According to the complaint, officers found blood near the club but were kept from entering it. Apparently there was an argument between rival gangs and a shot was fired but the wounded individual was never located, according to the complaint.

A security guard fired two rounds but then there were efforts by fellow guards to hide weapons, the complaint alleges. The Clark County code prohibits security guards from carrying firearms.

Nicholas Herda was charged with a misdemeanor for hiring an employee without a required work card and failing to provide adequate security. A security officer was charged with a misdemeanor for possessing a firearm while on the premises and an emergency order was issued for an eight hour closure of the business.

The control board complaint said police met with Nicholas Herda numerous times in order to get him to comply with local ordinances.

The Herdas now have a chance to answer the new allegations posted this week on the website and could face a fine and disciplinary action against the gaming license.
