Lawsuit challenges petition to repeal tax increase

CARSON CITY — The legal battle is continuing over whether to allow Nevadans to vote in 2016 to repeal Gov. Brian Sandoval’s $1.3 billion tax increase.

Chuck Muth, a Las Vegas conservative, filed a referendum petition to repeal the tax increase. But a District Court judge in Carson City ruled the petition was defective and could not be circulated to gather voter signatures.

Muth then filed another petition with the Secretary of State.

To get the issue on the November 2016 ballot, a petition must be signed by 55,234 registered voters.

The Coalition for Nevada’s Future filed a lawsuit Tuesday in Carson City District Court to block the second petition.

Coalition attorney Matthew Griffin said the second petition is the same as the first one and should be blocked from going forward. He argues it contains multiple subjects, which is against a law that states a petition must have a single subject.
