Court rejects wrongful death lawsuit against Metro Police

CARSON CITY — A federal appeals court today rejected the petition of a Las Vegas mother seeking to sue Metro Police and two of its officers over the killing her son in 2011.

The 9th U.S. Circuit Court of Appeals ruled that Officers Christopher Grivas and David Hager were entitled to “qualified immunity” when they shot and killed Rafael Alonso Olivas, who was threatening them and coming at them with a butcher knife, according to court records.

The victim’s mother, Alma Chavez, filed a $9 million wrongful death lawsuit against the officers and the police department.

U.S. District Court Judge Larry Hicks dismissed the suit.
