Appeal rejected for Las Vegas man who killed neighbor after noise spat

The Nevada Supreme Court has upheld the murder conviction of a Las Vegas man who gunned down his neighbor after an argument over a slammed door.

Demetrius L. Brock said in his appeal he never intended to kill Tyrolia Belt in the parking lot of the Falcon Landing Apartments, 5067 Madre Mesa Drive, near the North Las Vegas Airport, in November 2012.

Prosecutors said Brock initially approached the victim and told him to quit slamming his apartment door. A heated argument ensued. Later in the day, Brock encountered Belt, drew a gun from his backpack and fired 15 shots, with five of them hitting the victim while he lay on the ground.

Brock, who was 44 years old at the time of the shooting, said he fired on Belt because he feared for his life.

Brock maintained there was insufficient evidence to support the second-degree murder conviction. He was sentenced to consecutive terms of 10 years to life and eight years to 20 years.

The court said the jury could reasonably find that Brock acted with malice to justify the second degree murder conviction.
