Court says union’s Bat Signal-like protest message not trespassing

CARSON CITY — The Nevada Court of Appeals has ruled a Las Vegas labor union was not trespassing when it shined a light with a protest message on the wall of an upscale shopping mall in 2014.

Members of the International Union of Painters and Allied Trades were standing on a sidewalk outside Tivoli Village at night when the incident took place, according to court records.

The court overturned an injunction issued by the District Court, which ordered the union to stop beaming the light.

The mall’s owner, Great Wash Park LLC, had sought the court order, claiming the protest message was hurting business and the union was trespassing, according to the documents.

The union was protesting that Great Wash hired a nonunion contractor and nonunion workers for construction of the second phase of development, documents said.
