Ely councilwoman’s assault charge by fellow member dismissed

An assault charge made by an Ely City Council member against a fellow councilwoman over a remark has been dropped.

The Ely Times reported (http://bit.ly/2bOs8mw ) Friday that a judge dismissed an assault complaint Jolene Gardner made against Pat Robison.

According to the complaint, Robison said she wanted to put Gardner "under the table" during a meeting last July.

White Pine County Assistant District Attorney James Beecher says no "reasonable person" would have felt threatened.

Beecher says an assault has to be either an attempted battery or putting someone in reasonable fear of bodily harm.

His office did not find that after reviewing video and audio.

Robison says she is glad the incident is now behind her.

Gardner said she had no comment when reached by the newspaper Friday.
