Man ordered to prison for running too slow gets new hearing

CARSON CITY — Mauricio Martinez of Las Vegas pleaded guilty to burglary, was placed on probation and ordered to enter boot camp.

During his 156 days in boot camp, he lost 100 pounds and reduced his timed two-mile run from more than 30 minutes to 18 minutes, according to Nevada Supreme Court records. He had no disciplinary markups.

But he failed a requirement to run two miles in 15 minutes or less and do at least pull-up. As a result, his probation was revoked by District Court Judge Douglas Herndon, and he was sentenced to 12 to 30 months in prison, according to court records.

The Nevada Supreme Court today overturned the probation revocation. It ordered Herndon to conduct a new revocation hearing without considering Martinez’s failure to meet the physical requirements.

The court said nothing in the records suggests Martinez was not physically fit. The court noted, however, that its ruling applies only to Martinez.
