Legal opinion: State investigations of doctors not public

CARSON CITY — An investigative committee of the state Board of Medical Examiners is exempt from Nevada’s open meeting law, according to a legal opinion from the state Attorney General’s Office.

The opinion says the law provides that proceedings before the committee are confidential, as are all documents and information compiled during a probe.

The committee investigates charges of misconduct by doctors and can recommend a disciplinary complaint be issued by the board. Formal complaints by the board are public.

The doctor who faces the allegations can ask for a hearing to provide a defense.
