State’s top court hearing in school voucher case is postponed

The Nevada Supreme Court has reset oral arguments for July 29 in Las Vegas on the appeal involving the validity of the school voucher law.

The arguments were originally scheduled for July 8, but the state Attorney General’s Office asked for a continuance because its private counsel Paul Clements would be unavailable on that date. The motion was unopposed by the parents who are challenging the law that would provide a $5,100 subsidy to parents who send their child to a private or parochial school.

District Judge James Wilson of Carson City ruled the law was invalid because it took money away from the public schools. The Attorney General’s Office has appealed that decision to the Supreme Court.

In another case on the same issue, District Judge Eric Johnson of Las Vegas ruled that the law did not violate the constitution that prohibits public money being spent for sectarian purposes.

The Attorney General’s Office says it expects an appeal from that ruling so both cases could be heard at the same time.

So far no appeal has been filed with the Supreme Court on the Johnson ruling.
