A jailed Metro Police officer is accused of sexually assaulting his wife’s best friend as the woman slept in their house, according to an arrest report.

The alleged victim, a California woman who was visiting her friend, said she woke up early Saturday to find Manuel Gutierrez on top of her, according to police.

The woman said Gutierrez had nonconsensual sex with her, while he said she was awake when he walked into the room and that she made sexual advances, police said.

Detectives believed the woman and arrested Gutierrez, 37, on a count of sexual assault, police said. He remained jailed this morning at the Clark County Detention Center on $25,000 bail.

After the alleged attack, the woman left her friend’s house and went to Southern Hills Hospital, where officers were summoned about 5:30 a.m., police said. She was then taken to University Medical Center for a rape test, which did not identify signs of injuries or semen, police said.

Gutierrez, his wife and her friend were drinking alcohol before they went to bed, police said.

Gutierrez said he went into the room where his wife’s friend was staying to make sure the dogs hadn’t gone inside, police said. He said he rubbed her shoulders and thanked her for “being a great friend to his wife,” according to the report.

He said she initiated the sexual contact, according to police.

Gutierrez, who is assigned to Metro’s South Central Area Command, was suspended without pay while the investigation is ongoing, police said.
