Nightclub server’s harassment lawsuit to be dismissed under agreement

A "Jane Doe" lawsuit alleging wrongdoing at Las Vegas casino restaurant and nightclub operator the Light Group will be dismissed under an agreement disclosed Wednesday.

The suit, filed last month, claims the former VIP cocktail server at Jet nightclub at the Mirage was subjected to sexual harassment and that management promoted drug and alcohol abuse there.

The Light Group had denied the allegations, calling the plaintiff a substance abuser and labeling her accusations false and "outrageous."

A stipulation to dismiss the case filed in federal court in Las Vegas doesn't say why it's being dismissed or whether a settlement was reached.

Before dismissing the suit, attorneys for Jane Doe and the Light Group agreed to allow Jane Doe to amend the lawsuit by dropping as defendants Andrew Sasson and Andy Masi.

This was because they were named in the lawsuit only because of their ownership interest in the Light Group and related entities "and there is no evidence that Andrew Sasson or Andy Masi were directly involved in the conduct alleged in the complaint," the stipulation says.

That left as defendants the Light Group LLC, Dancing Monkey LLC dba Jet Nightclub, Phil Licada, James Scott, Dan Diagostino and James Reyes.

With the defendants having never filed court papers answering the allegations, the case will be dismissed in its entirety under a stipulation filed Wednesday by Jane Doe's attorneys and Scott Mahoney of the law firm Fisher & Phillips, LLP, attorney for the remaining defendants.

Jane Doe is represented in the case by the Las Vegas law firms Michael J. Amador Chtd. and Marquis & Aurbach.

A Light Group spokesman today said the company was unable to comment on the stipulation for dismissal of the lawsuit.
