A 16-year-old girl who was one of six young defendants charged with murder and robbery in the death last year of Timothy Van Derbosch, a Las Vegas high school teacher, will be released on house arrest, according to a deal worked out with the Clark County District Attorney’s office.
The deal for Marisol Diaz, which was approved today by District Judge Joseph Bonaventure, puts 12 conditions on her, including requiring her to wear an electronic monitoring device and also requiring that she testify in upcoming trials of other defendants in the case.
The six defendants were indicted for murder and numerous felonies in five separate robberies and attacks.
Those include the attack that led to the death of VanDerbosch, a 50-year-old Eldorado High School physics and chemistry teacher. VanDerbosch died when he was hit by a truck after being attacked on the morning of Oct. 20, 2010, while walking to school.
Diaz, who shed tears when she learned she would be released, has been held without bail in the Clark County Detention Center since Nov. 9, 2010.
Several of Diaz’s family members and friends who were in the courtroom hugged each other and wept in court.
Chief Deputy District Attorney Robert Daskas said he had no comment on the conditions because several of the cases are still pending.
However, the house arrest release order does contain a condition that Diaz must testify in the upcoming trials of four of the defendants in the case.
Bridget Lugo, 20, will have her jury trial at 10:30 a.m. Dec. 5, and Marcos Coronel Castrejon, 20, will have his trial at 10:30 a.m. Feb. 21.
Two defendants are facing the death penalty. Saul Farvela, 19, will have his trial at 10:30 a.m. March 5, 2012. And David Rosas, 20, will have his trial at 10:30 a.m. April 9, 2012.
One of the defendants, Daniel Carrillo, 16, has made a plea agreement rather than going to trial and is scheduled to be sentenced at 9 a.m. Oct. 7 before Judge Jennifer Togliatti.
Bonaventure set Diaz’s next court appearance for 9 a.m. Feb. 21 to reset the date of her trial.
