ELKO — A judge has set free a Carlin man who served 17 years in prison for the killing of a toddler after the Nevada Supreme Court overturned his conviction and he agreed to a plea deal on a charge of involuntary manslaughter.
Elko County District Court Judge Nancy Porter sentenced Patrick McCormick on Tuesday to up to four years in prison. But the Elko Daily Free Press reports she granted him credit for time served, which means he has completed his sentence.
McCormick was convicted of first-degree murder in 1996 in the death of 14-month-old Jacob Jones, the son of a woman he'd been living with. The Supreme Court overturned the conviction in 2012 on grounds of ineffective legal counsel, saying a penicillin allergy couldn't be ruled out as the cause of death.
