Elko City Council to consider banning marijuana dispensaries

ELKO — The Elko City Council is poised to consider banning medical marijuana dispensaries within the city limits.

The Elko Daily Free Press reports the City Council will take up the issue Tuesday at the request of Police Chief Ben Reed.

Nevada voters approved allowing marijuana for medicinal purposes in 2000, but the only way patients could obtain the drug was to grow it themselves. A law passed by the 2013 Legislature and signed by Gov. Brian Sandoval sets up a regulatory system to make medical marijuana more easily accessible to patients.

But the law also allows cities and counties to opt out of allowing medical pot operations in their jurisdictions.

Reed says he concerned the Nevada statute conflicts with federal law, under which marijuana possession is a crime.
