Court overturns man’s death sentence, orders new hearing

CARSON CITY — The Nevada Supreme Court has admitted it made a mistake in a previous decision and ruled that a Las Vegas man convicted in a 1990 slaying is not eligible for the death penalty.

The court, however, rejected a petition from Curtis Guy to overturn his first-degree murder conviction. It ordered the District Court to conduct a new penalty hearing.

Guy was driving a vehicle in North Las Vegas when a passenger shot a man. The court ruled that Guy was not a “major participant” in the crime as required to receive a death sentence.
