Federal court upholds ecstasy drug conviction

CARSON CITY — A federal appeals court today rejected the petition of Micah Joel Ahkeem Iverson Kelly, convicted of possessing and selling 446 grams of ethylone, also known as ecstasy.

He was arrested after two sales to an undercover agent in Las Vegas in 2015 and pleaded guilty to three counts of sale and possession of the drug. He was sentenced to 70 months in prison.

The 9th U.S. Circuit Court of Appeals rejected Kelly’s claim that the drug was not listed on the controlled substance list by the Drug Enforcement Agency and it, therefore, was not a crime to sell it at the time.

But the court said the drug had temporarily been placed on the list at the time of Kelly’s arrest.
