Donald Trump, Fox News and others in conservative media claiming it is not a crime to pay a porn star hush money during an election.
That would be the case if Trump had just written his own personal check to Stormy Daniels for the $130,000. A candidate can contribute unlimited amounts to his own campaign and it is not illegal to pay for a nondisclosure agreement.
The only explanation for Trump not doing that is that he was doing something nefarious. This is shown by him using his attorney to write the check and his use of his business accounts to reimburse the attorney as a legal fee.
Obviously, being a cheapskate, Trump was trying to deduct the payment as a legal fee for the business. Thus, he is being charged with falsifying business records.
