Court rejects candidate’s suit

The court decided Thursday to dismiss the lawsuit that Brendan Trainor filed against Assemblywoman Jan Evans, D-Sparks. Trainor said the separation of powers clause of the Nevada Constitution bars Evans from serving in the Legislature.

When not in the Legislature, Evans works as assistant director of development for the University of Nevada School of Medicine. The Legislature approves spending for the medical school.

Evans said she was gratified by the court's decision, although she does not expect Trainor to give up his battle. She said he has made four unsuccessful attempts in various courts to make her resign from her job or seat in the Legislature.

"He simply refuses to look at all the documented information out there," she said. "This is four strikes and you're out. It ends it for me."

The Ethics Commission also ruled that Evans could serve in the Legislature and retain her university job.

During the six months the Legislature is in session every two years, Evans said she takes an unpaid leave of absence from the medical school.

Trainor twice ran for Evans' seat. He ran unsuccessfully for another Assembly seat last year.
