Letter: Institute doesn’t brainwash local housing organizations

CAI Nevada is one of 56 chapters formed to provide education to association boards, homeowners, managers and other industry professionals. The organization also researches trends and issues affecting common interest communities. Members include builders and developers, association leaders, public officials, managers. Realtors, accountants, attorneys, service providers and homeowners.

Due process, fiduciary responsibility and communication are major components of all the programs and seminars offered by CAI. Our goal is to provide association leaders with the tools and knowledge to protect and enhance the value of their communities. Unfortunately, some boards may not act in the best interests of their members. Many homeowners buy into a common interest community without reading the CC&Rs or bylaws and with complete disregard for the rules and regulations. We do not condone such actions, nor does CAI have any enforcement or regulatory powers over these violations.

The authority to place liens or foreclose on property is granted to boards in the CC&Rs which are created by the developer. This authority is included in almost all CC&Rs, regardless of what year they were created and has nothing to do with CAI lobbying efforts or the Homestead Act.

I believe that the majority of homeowner associations are well managed and homeowners are generally satisfied with the lifestyle and protection afforded by their association.
