Assembly seat OK’d by court

CARSON CITY -- After sitting on the case for three years, the Nevada Supreme Court has finally issued a one-page ruling that Assemblywoman Jan Evans is eligible to serve in the Legislature.

It rejected the challenge of Libertarian candidate Brendan Trainor that Evans, a Sparks Democrat, is ineligible because she is assistant director of development for the University of Nevada School of Medicine. Trainor complained that an executive officer of a state agency serving in the Legislature violates the separation-of-powers doctrine.

A protest he filed after he lost in 1993 was unsuccessful. He appealed to the high court in 1994. Lorne Malkiewich, director of the Legislative Counsel Bureau, which represented Evans, said he sought to have the decision speeded up so there would be no question in the 1994 election.

But the court didn't rule and Evans won in 1994 and again in 1996.
