Board approves $2 million settlement in traffic death

CARSON CITY – The state Board of Examiners has approved a $2 million settlement to a Las Vegas man that likely will cost the state $3 million or $4 million.

The settlement goes to Michael Delew, whose wife Erin was killed when her bicycle was hit by a car driven by Janet Kathleen Wagner, the wife of a Metro Police officer. State officials said the cost of the settlement will rise another $1 million to $2 million for fees for attorneys who have carried the case for 14 years.

A federal judge will determine the amount of the fees due to Delew's lawyers.

Delew claimed the Nevada Highway Patrol mishandled the investigation in 1994 because the driver of the car was the wife of a Metro officer.

Clark County has already settled for $1.4 million.
