Court clears Trump hotel in Las Vegas of liability in elevator case

CARSON CITY — A federal appeals court has cleared Trump International Hotel in Las Vegas of any liability in a lawsuit that says a family was injured in a free fall of a defective elevator.

The U.S. Ninth Circuit Court of Appeals ruled Friday there “was no direct evidence of negligence” on the hotel’s part, but the suit could continue against Otis Elevator Co., which was under contract to maintain and repair the elevator.

The family filed the lawsuit against Otis and four Trump companies, claiming the 2009 incident resulted in injuries.

The court mostly upheld the decision of U.S. District Court Judge Gloria Navarro, who granted a pretrial summary judgment in favor of Otis and the Trump companies.

In ordering the case back to U.S. District Court in Las Vegas, the appeals court said there was a videotape of the incident and that is sufficient evidence to merit further action by the Las Vegas court.
