Court files wrong decision in campaign donation case

CARSON CITY — The Nevada Supreme Court made an error in filing a decision finding that the conservative group Citizen Outreach violated Nevada’s campaign contribution law.

“A mistake was made in the clerk’s office,” Chief Justice James Hardesty said.

A decision was issued earlier this week ruled Citizen Outreach had failed to submit a list of contributors to the Secretary of State’s Office in its campaign against Las Vegas Democrat Assemblyman John Oceguera in 2010.

The 5-2 decision upheld a District Court ruling that levied a $10,000 fine.

But on Wednesday the court issued the correct 5-2 ruling that found Citizen Outreach did not violate the law by not submitting its list of contributors.

Hardesty said alternate decisions were considered by the court, and the clerk’s office filed the wrong one. He said this was the first time this has happened since he joined the court in 2005.

He said as soon as he realized the error, he ordered a correction.
