Court rejects death row inmate’s petition

CARSON CITY — In a split decision, the Nevada Supreme Court today rejected a petition by death row inmate Kevin James Lisle, who maintains he is innocent in the drive-by shooting of another man in 1994 in Clark County.

Lisle, through his attorneys, said he should not be sentenced to death because new evidence showed he was not the shooter in the death of 19-year old Kip Logan, who was killed after he stopped on an empty road in October 1994.

Lisle asserts new evidence shows the triggerman had facial hair and that he was clean shaven. He accused a codefendant of being the gunman and asked that the District Court to hold a hearing on the new evidence.

The court, in the 5-2 majority decision written by Justice Ron Parraguirre, said Lisle failed to demonstrate his innocence or that he should not be given the death penalty.
