CARSON CITY — Nevada is fighting back against the second of two legal challenges that seek to dismantle the state's broad new school choice program.
The Nevada Attorney General's Office asked a court Thursday to dismiss a lawsuit filed against Education Savings Accounts by Democratic former state Sen. Justin Jones and others. The program allows parents to claim a portion of their child's per-pupil state education funding and use it toward expenses such as private school tuition.
The suit asserts that the new law violates a portion of the Nevada Constitution barring the use of state education funds outside of the public school system.
The attorney general argues that the Legislature has broad powers to encourage education by all suitable means.
The program also faces a lawsuit from the American Civil Liberties Union.
