Judge stays ruling on Nevada minimum wage

CARSON CITY — District Court Judge James Wilson has stayed his ruling that found parts of Nevada’s minimum wage law unconstitutional.

Wilson said there are “serious legal questions” to be decided by the Nevada Supreme Court. An appeal has already been filed with the Supreme Court by the Nevada Office of the Labor Commissioner.

Wilson found that employers cannot include worker tips in calculating the state’s minimum wage of $7.25 an hour or $8.25 an hour. He ruled employers must provide health insurance for workers paid the lower wage of $7.25 an hour.

The Office of the Labor Commissioner has allowed employers to count tips as part of wages.

Labor Commissioner Shannon Chambers said that based on the stay, her office will continue to follow existing regulations until the Supreme Court rules.
