Court says prisoner can pursue lawsuit over false teeth

CARSON CITY — A prison inmate is going to get a chance to prove state correction officials were negligent in failing to supply him with proper fitting false teeth for two years.

The Nevada Court of Appeals on Tuesday ruled that Brian Kamedula could proceed with a lawsuit against state Department of Corrections officials.

Kamedula, serving a life term with the possibility of parole for a 1987 sexual assault conviction, maintains he was given improper fitting dentures at the Lovelock Correctional Center in 2012 and didn’t receive a proper fitting set of teeth until last year.

The court overturned the decision of Pershing County District Court Judge Richard Wagner, who held that a prior federal court settlement regarding medical issues prevented Kamedula from bringing the claim.

The case will now return to District Court for further proceedings. The court also said Kamedula could pursue his claims that money was removed from his personal account in retaliation for filing a prior suit.
