The former Boulder City police chief who declined to seek charges against an animal control supervisor after an investigation into the deaths of more than 90 shelter dogs is facing a misdemeanor charge of failure to perform his public duty.
Records show that former Boulder City Police Chief Bill Conger is scheduled to appear April 19 in Boulder City Justice Court. He wasn't arrested.
Conger declined comment Thursday to a local reporter. His attorney, Tom Pitaro, didn't immediately respond Friday to messages from The Associated Press.
Conger resigned in January, after he was blamed for not seeking charges against former Boulder City animal control chief Mary Jo Frazier.
Frazier pleaded not guilty in March to two felony animal cruelty charges that could get her up to eight years in prison.
