Courts says Parole Board overstepped its authority

CARSON CITY — The Nevada Supreme Court has ruled the state overstepped its authority in setting conditions for sex offenders on lifetime supervision.

The court today overturned the conviction in Las Vegas of a man who challenged some of the rules he was required to comply with. He was convicted of a felony for failing to follow of the conditions.

The unanimous decision said the state Board of Parole is limited to setting conditions prescribed under the law and cannot go further.

In the case in question, the board ordered the man to submit to a urinalysis, abide by a curfew and maintain full-time employment, according to court records. The court said the conditions were unlawful because they had not been approved by the Legislature.

The man was also convicted of failure to have a residence approved by the parole board. That is a legal requirement in the law, and he must be retried on that allegation.
