Prosecutors are seeking the death penalty for two of three men charged in the slaying of a clerk during a robbery in April at a Lee’s Discount Liquor store, the Clark County District Attorney’s Office announced today.

“Nevada law provides for the death penalty to be sought in certain circumstances,” District Attorney Steve Wolfson said in a news release. “It is reserved for the worst of the worst.”

The death penalty is being sought for Lee Dominic Sykes, 20, and Ray Charles Brown, 24, officials said. The district attorney did not say why a third suspect, Lee Murry Sykes, 22, is not facing the death penalty.

All three men are charged with murder, robbery, kidnapping, armed burglary, coercion with a deadly weapon, conspiracy to commit robbery and assault with a deadly weapon.

Metro Police allege Brown shot and killed Matthew Christensen after the trio stormed the store at 8785 W. Warm Springs Road, near Durango Drive, about 9:45 p.m. on April 18. Security video showed at least two were armed, police said.

The alleged gunman might have become frustrated and shot Christensen when he couldn’t open a safe, police said.

Lee Dominic Sykes and Brown were arrested May 3, and Lee Murry Sykes turned himself in the next day as authorities closed in, police said.
