Court rejects parent intervention lawsuit over private school subsidies

CARSON CITY — The Nevada Supreme Court today rejected the petition of six parents who support a private school subsidy program to intervene in an appeal on the constitutionality of the law.

They asked a District Court judge to let them become a party to the lawsuit. The judge refused their request, and the Supreme Court upheld the decision.

The opinion, written by Justice James Hardesty, said the interests of the parents are adequately represented in the legal battle by attorneys from the state and private firms.

District Court Judge James Wilson of Carson City ruled part of the subsidy law was unconstitutional because it took money away from the public schools. The state, through the office of Treasurer Dan Schwartz, filed the appeal.

Hardesty said the parents who want subsidies share the same interest as Schwartz. The court said there is no conflict between the interests of the six parents and Schwartz.

No oral arguments have been set in the Supreme Court on the issue of the validity of the law.
