Long battle between Boulder City and resident back in court

CARSON CITY — The 9th U.S. Circuit Court of Appeals today ordered the federal District Court in Las Vegas to take another look at a long battle between Boulder City and at least one of its residents.

The legal fight started in 2006, when residents presented initiative petitions to bar the City Council from spending more than $1 million without voter approval, to require the city to operate only one golf course and not subsidize two others, and to limit appointees to boards and commissions from to serving no longer than 12 years.

Boulder City sued the backers of the initiatives and won several court decisions.

Nancy Nolette was one of those backing the initiatives. The appeals court said Nolette maintains her legal injuries were caused by Boulder City and its alleged policy of repeatedly suing citizens in violation of their constitutional rights. Boulder City has argued she cannot pursuing claims against the city.

The appeals court said it was not ruling on Nolette’s claim of First Amendment violations.

It said the District Court, which dismissed her suit, should reconsider Nolette’s claim that she is not precluded from continuing her legal actions.
