Trump to try again with 9th Circuit Court of Appeals nominee

SAN FRANCISCO — President Donald J. Trump is trying again to nominate a former adviser to then-Attorney General Jeff Sessions to the U.S. Ninth Circuit Court of Appeals.

The White House on Friday announced Trump would nominate Patrick J. Bumatay, an assistant U.S. attorney in the Southern District of California, to the busy appeals court headquartered in San Francisco.

The Sacramento Bee reports that Trump nominated Bumatay in October, which prompted U.S. Sen. Dianne Feinstein of California to issue a statement complaining Bumatay had "no judicial experience."

Feinstein is the senior Democrat on the committee that confirms judicial nominees.

The Senate did not take up the nomination and it expired.

Trump also wants on the appeals court Lawrence VanDyke, a deputy assistant attorney general at the Department of Justice.
