Lawyer appeals ruling to reinstate charges against her

Audrey Damonte filed an appeal Friday with the Nevada Supreme Court in an effort to overturn Senior Clark District Judge Carl Christensen's May 8 ruling that a lower court judge was wrong in dismissing the hit-and-run charge.

Her action automatically stayed a jury trial scheduled to begin Sept. 29 in Carson District Court.

Damonte, 32, of Reno, pleaded innocent to the charge May 23.

Damonte struck and killed pedestrian Don Ferris, 42, on U.S. Highway 395 in Carson City. She drove away and did not turn herself in for another six hours, authorities said.

Damonte is appealing Christensen's ruling that she had a legal obligation to stop for any type of accident.

Damonte contends she did not knowingly contend a crime because she did not know she had hit a person.
