Houston Hite committed suicide in the jail cell after he was arrested in October 1995 for the alleged sexual assault of a 10-year-old girl.
His mother and wife said sheriff's deputies and two jail trustees didn't take enough action to prevent the death.
District Judge Michael Griffin threw out the case. A similar claim was rejected eight months ago in U-S District Court. An attorney for the family says they may appeal.
