David Sarnowski, the state's chief deputy criminal attorney general, said the charge may be filed against Juan Pedro La Peire, 22.
Three other inmates were indicted earlier for the murder. One of them, Richard Irvine, 32, hanged himself in his prison cell Saturday. The others are Robert Ryan Rowland and Tony Smith.
La Peire was in Carson City District Court on Monday for an arraignment on accusations of robbery and burglary-related charges in connection with the murder. He pleaded innocent.
Prosecutors say Silva was beaten by Rowland and Smith because he was selling his Methadone pills to another group.
La Peire was the lookout when Silva was beaten and helped to carry stolen items from Silva's cell, according to grand jury transcripts.
