Former mayor charged in fatal accident

The Nevada Attorney General's Office announced plans last week to prosecute Montrose, the Lovelock Review-Miner reported.

Pershing County prosecutors turned the case over to the state earlier this year, citing a conflict of interest because of their past and current involvement with Montrose.

Montrose, 59, surrendered to the sheriff's office and was released on his own recognizance. He awaits a Nov. 5 preliminary hearing in Lake Township Justice Court.

An investigative report by the AG's office concluded that Montrose's failure to stop at a stop sign caused the Oct. 2, 1997 collision that led to the death of Kraig L. Kearns, 37.

Montrose was eastbound on Peterson Road near Lovelock when his pickup collided with Kearns' southbound vehicle on Westfall Road.

Traffic on the latter road was not required to stop, according to the report.

If convicted, Montrose faces up to four years in prison and a $5,000 fine.
