Studio firm sues Henderson

An entertainment studio company that wants to build a $200 million facility in Henderson has filed a lawsuit against the city in District Court in hopes of resolving a dispute over the purchase of nearly 85 acres of commercial land.

Black Mountain Studios filed the suit Tuesday seeking a court order that would force the city to follow through with an agreement to sell the land in chunks.

So far, the company has purchased only 20 acres for $1.2 million, but apparently missed contractual dates to purchase additional plots.

The lawsuit claims a "mutual mistake" in the wording of the contract has not allowed the company to delay the purchase of the six plots. The contract allows the purchaser to "accelerate" the schedule. The lawsuit asks that a judge order the words "or delay" be inserted.

The Henderson City Council earlier this month denied the first phase of the proposed project.
