Brief: Resort sued by Hall of Fame over eviction

Retonio's Las Vegas Hall of Fame Inc., which has operated the Magic and Movie Hall of Fame at O'Sheas Casino, 3555 Las Vegas Blvd. South, filed suit in Clark County District Court seeking a restraining order and an injunction to prevent the operation from being evicted from the casino, which is operated by the Flamingo Hilton.

According to the suit filed by attorney Theodore Manos, the Hall of Fame negotiated a three-year lease with two six-year options in 1992 for 19,604 square feet on the second floor of the casino for a memorabilia display and sales.

The suit says the Hall of Fame paid a $250,000 security deposit to Flamingo Hilton that was to be returned as construction progressed. The suit says the Hilton returned all but $50,000, which was kept as additional security.

The Hall of Fame began withholding rental payments in April to recover the $50,000. Hilton said that amount was exhausted in October, but the Hall of Fame maintains that Hilton had additional funds available because of interest accrued on the deposit.

On Dec. 18, Hilton ordered the Hall of Fame out of the casino for failure to pay rent.

The Hall of Fame suit seeks a declaration that it be entitled to interest on the $50,000 that was deposited with Hilton since July 1, 1994, as well as the restraining order and injunction.
