Strip smut hearing bounced

A second hearing in two weeks on whether sexually oriented pamphlets can be distributed in front of Strip hotels was taken off District Court calendar today as the case bounces between state and federal courts.

The matter of the Venetian hotel-casino vs. seven outcall services was taken off the calendar of District Judge Mark Gibbons because the defendants filed a motion last week to move the case to federal court as a First Amendment issue.

Last Friday attorneys for the Venetian filed a motion to send the case back to District Court, arguing this is a state law matter regarding trespassing and nuisance, not a free speech issue.

Both motions are under consideration.
