Resort sues over jetliner noise

The Alexis Park Resort and Spa sued Clark County, claiming the new north-south runway at McCarran International Airport resulted in noisy jets bothering its guests.

The lawsuit suggests closing the runway in order to protect the integrity of the Alexis Park's air space rights, as well as financial damages.

The resort says it was granted an air space easement of up to 90 feet in 1983 and 1984, but Clark County reduced the maximum height to 39 feet on a portion of the Harmon Avenue property when the new runway was constructed a few years ago.

That reduction, in effect, "condemned and confiscated the property without compensation or due process," the lawsuit claims, adding the reduction impairs further multi-story construction at the Alexis Park site.

The lawsuit, filed through attorney Mark James, states the centerline of the flight path is now just 400 feet from the Alexis Park rather than the quarter mile that had been the case.

That has kept guests from getting uninterrupted sleep, hampering the ability of the resort to operate effectively, the lawsuit contended.

Rosemary Vassiliadis, deputy director of aviation for Clark County's Department of Aviation, said airport officials have not seen the suit and had no comment on it.
