District Judge Michael Fondi ruled on Monday there was no violation in spending $9,900 in city money to hire a private attorney to defend Waters and Bannister from a first removal attempt by Ron Weddell.
Weddell filed the first petition for the officials' removal, along with the removal of seven sheriff's deputies and a deputy district attorney, in March 1998 and Fondi dismissed the petition without a hearing.
Weddell appealed the dismissal to the Nevada Supreme Court, which is expected to rule in about a month.
Meanwhile, Weddell still faces felony and gross misdemeanor charges for firing shots at one of the men he believed kidnapped his daughter. Weddell maintains he was conducting a legal citizen's arrest.
The failure of Waters' and Banister's offices to prosecute the men Weddell says kidnapped his daughter lead to the original removal filing.
