Resort sues smut peddlers

On Tuesday, the resort filed a lawsuit in Clark County District Court against three Las Vegas companies and four local individuals, claiming they have repeatedly distributed fliers promoting "adult entertainment and prostitution" in front of the Venetian.

The resort is seeking unspecified damages, as well as a court order that would ban the distributors from the sidewalk.

In its lawsuit, the Venetian contends that the Strip sidewalk in front of the resort is the Venetian's private property, and that the defendants' actions constitute trespassing. In its filing, the Venetian referenced a 1996 court order that banned one defendant, Jaime "Hymie" Romero, from distributing fliers on the sidewalk, then owned by the Sands.

Also named as defendants were Believers Inc., Hillsboro Enterprises Inc., S.O.C. Inc., and individuals Mariano Ojeda, Jose Resto and Elias Zarate-Piguinto. None of the defendants could be located for comment.

The Venetian earlier lost its last battle to declare the sidewalk private property. On April 27, U.S. District Judge Philip Pro denied the Venetian's request for a preliminary injunction and restraining order against the Culinary and Bartenders Union, which was picketing on the sidewalk.

In that decision, Pro ruled that rights of private property didn't extend to a sidewalk that performed all of the functions of a public sidewalk. The Venetian has appealed that ruling.
