Henderson homeowners sue over damage

Some 200 homeowners of Promontory Point are seeking class action status against their homebuilder, Promontory Point General Partnership doing business as Gateway Development of Las Vegas, alleging severe water damage at their 200-unit single family home development off Warm Springs Road and Arroyo Grande Blvd. in Henderson.

The class action petition, which will be filed today at Clark County District Court, began with complaints filed around May 1998 by eight homeowners. It alleges homes were damaged due to problems with compaction faults that led to a rise of groundwater beneath their homes.

Compaction faults, part of the natural geography of the area, are impenetrable underground walls of rock obstructing the path of ground water. Since the water can't penetrate the rock, it is then forced to come up to the surface.

Betsy Gonzales, the defendants' attorney said, "We're still investigating the suit, and at this point no conclusions have been reached by the defendants on the nature and extent of the allegations as well as reponsibility for the problem."
