District Attorney: Teacher can's sit on school board

Doyle said many similar court cases in other states support the local school district's position that it's illegal for teachers to sit on a school board in the same district where they teach.

Douglas District Judge Michael Gibbons will hold a hearing Friday on the school district's lawsuit seeking to keep Green off the board. Green was elected to the board in November.

The school district is seeking an order from Gibbons on the legality of Green serving on the board.

Doyle prepared a response to the lawsuit for county Clerk-Treasurer Barbara Reed, who was named as a defendant along with Green in the lawsuit.

The school district is seeking to prevent Reed from administering the oath of office to Green. County officials will be sworn in Jan. 1.

But Green lawyer George Keele says school board members whose spouses are employed by the school district also have a conflict of interest.

If they're allowed to sit on the board, he says, so should Green.
