Wrong builder named in suit

Sixteen Marble Canyon homeowners dropped their class action lawsuit against Kaufman and Broad of Nevada Inc. after learning Kaufman and Broad didn't build their homes.

Attorneys for the homeowners, who filed the complaint on May 8 alleging numerous defects in the 78-home Marble Canyon development in Summerlin, said in a notice of voluntary dismissal filed June 22 they "erroneously" named Kaufman and Broad as a defendant.

The suit was amended to name Plaster Development Co. Inc. as the defendant builder of the Marble Canyon development. Plaster could not be reached for comment.
