Execution stay issued in Mack case

CARSON CITY -- The state Corrections Department said today that a stay of execution has been issued for Daryl Mack, 45, convicted of the rape-strangulation of a Reno woman in her home in October 1988.

Mack was scheduled to enter the death chamber March 5. But his attorneys will now have a chance to pursue further appeals after the district judge's decision to stay the execution.

Mack was originally convicted and sentenced to life in prison for the strangulation of Kim Parks in a Reno motel in 1994. He was serving his sentence when investigators linked him in 1998 to the killing Betty Jane May in 1988.

Meanwhile, U.S. District Judge Howard McKibben has set March 5 for a hearing for Lawrence Colwell Jr., who is scheduled to be executed the week of March 22 for the robbery and murder of Frank Rosenstock, 76 at the Tropicana Hotel in Las Vegas in March 1994.

Colwell has maintained he does not want to appeal further and wants to go to his death.

The last execution was on April 21, 2001, of Sebastian Bridges.

Since Nevada reinstated the death penalty, there have been nine executions.
